35 Failures

USA Today: "Of the 156 nominations that presidents have made for the Supreme Court since 1789, 35 have failed for one reason or another, including Harriet Miers..." Since he can make the excuse that he tried to elevate a woman, I wonder if it's now possible for Bush to push through a man. (via pw)

Nobody would vote against a nomination solely because they are male. He could have pushed through a man before Miers, they just need to be qualified. Hell, he was going to put Roberts into O'Connor's seat and these was no huge upswelling of anger about the gender issue then.

He'll probably go with another woman, but he's certainly not bound by it.

It was OK for Roberts because everyone knew Rehnquist wouldn't be around long.

I know Bush could've pushed through a man before Miers, but he would've received a lot of heat, especially from his wife. The question is: will he receive less heat now if he nominates a man?
